Terms of Service

These Terms govern your access to and use of Earth Palace, including our websites, applications, APIs we expose to you, and related features (together, the “Services”). By creating an account, signing in, or using the Services, you agree to these Terms.

Earth Palace is a globe-native personal operating environment. It is not a generic social network, not a hosted foundation-model lab, and not a consumer messaging app in the sense of WhatsApp, Telegram, or Signal. Where a feature is labeled Beta, Preview, Foundation, or Planned in the product, that label is part of the contract: it describes honestly what works today.

These Terms apply to the consumer Earth Palace product. Separate terms may apply later to business, education, or API offerings if we publish them. If there is a conflict between these Terms and a written order or supplemental policy we publish for a specific feature, the more specific terms control for that feature.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. We may provide, among other things:

• Globe Feed — a public feed of posts you and others publish, including text, photos, official third-party video embeds, and music attachments.
• My Feed — a private blend of items you keep for yourself.
• Earth — an interactive globe, Pocket Earth, Place Portal, Personal Orbit, and related Earth layers.
• Snuffy — a restrained AI companion you invoke. Snuffy is not an unsolicited assistant.
• Dashboard — Projects, Daily Notes, Connected Earth, and Library.
• Jam Surfer — radio discovery, playlists, uploads you own, and optional song identification.
• Drop — capture and organization of material you choose to save.
• Connected Earth — optional connectors to third-party services and AI providers you configure.
• Messages — 1:1 Earth Palace direct messages with end-to-end encryption on this device, plus optional connector overviews. This is not a personal WhatsApp, Telegram, or Signal inbox.

Features may be incomplete, region-limited, or available only when you connect a provider. We do not currently operate a third-party advertising network. If we introduce labeled Promote campaigns, paid plans, or other commercial products, we will update these Terms before those products apply to you.

You must be at least 21 years old to create an account. At sign-up we collect your date of birth so we can confirm eligibility. That date is stored privately on your account and is not shown on your public profile. Age confirmation is self-attestation, not government identity verification. Accounts created before this gate shipped may be grandfathered as described in the product.

You agree to:

• Provide accurate registration information and keep it current.
• Keep your credentials confidential and not share your account.
• Be responsible for activity that occurs under your account.
• Create only one personal account, unless we expressly allow otherwise.
• Notify us at team@earthpalace.com if you believe your account has been compromised.

You may not use the Services if you are prohibited from doing so under applicable law, including export-control and sanctions laws, or if we have previously disabled your account for a violation of these Terms.

You own the content you create, upload, or submit (“User Content”), including posts, media, music files, Drop captures, project files, profile information, and prompts you send to AI features. Nothing in these Terms transfers ownership of your User Content to us, except for the limited license below that we need in order to operate the Services.

To provide the Services you request, you grant Earth Palace a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, process, adapt (for technical formatting), display, perform, and distribute User Content solely as needed to operate, secure, and improve the Services, consistent with your privacy settings and the Privacy Policy. This is not a license to sell your content or to train public foundation models on it.

When you publish to a shared surface such as Globe Feed, other users may see, react to, comment on, and share links to that content according to the product. Content you keep private (for example My Feed items, Drop items you do not share, media vault files, memories, and connector credentials) is not offered to other users.

You represent that you have all rights needed to submit User Content and that it does not infringe others’ rights or violate law. You are responsible for User Content. We may remove or restrict content, or suspend accounts, when we reasonably believe these Terms, others’ rights, or the law require it.

The license ends when User Content is deleted from our systems, except that copies may remain in backups for a limited period, in logs we must retain, or where another user lawfully reshared the content before deletion (for example a comment quoting a post).

You may not, and may not assist others to:

• Use the Services for any unlawful, fraudulent, harassing, exploitative, or harmful purpose, including child sexual exploitation, trafficking, or violent crime.
• Post or share content you do not have the right to share, including infringing copyright, trademark, or other intellectual property.
• Attempt to access other users’ private data, bypass authentication, probe, scan, or breach security, or interfere with the Services (including rate-limit abuse, spam, or malware).
• Scrape, harvest, or use automated means to extract data from the Services except through interfaces we expressly provide and in accordance with robots.txt and these Terms.
• Reverse engineer the Services except to the extent that restriction is prohibited by law.
• Misrepresent AI-generated output as solely human-created where that would be misleading in context, or use output as a substitute for professional advice.
• Use the Services to develop competing foundation models by systematically extracting model output, except as allowed by applicable law.
• Impersonate others, operate under-21 accounts, or evade an enforcement action.

Globe Feed includes a report path for content you believe violates these Terms. Reports are reviewed as our capacity allows. We do not currently operate a full moderation console; enforcement may be manual and delayed. We may still remove content or disable accounts when required.

Earth Palace includes optional AI features: Snuffy, default Hermes availability, Living Agents, Drop suggestions, Daily Notes narratives, and related routing. You choose when to invoke them. Snuffy is designed not to nag, upsell, or act as Clippy.

Depending on your settings, a request may be sent to (a) a provider whose keys you stored in Connected Earth, (b) a local model running on your machine (for example Ollama), (c) a self-hosted Hermes Agent you configured, or (d) a platform default when one is offered. Those providers’ terms and privacy policies also apply to content you send them. We do not operate OpenAI, Anthropic, Google, OpenRouter, or similar labs, and we are not responsible for their services.

Earth Palace does not train public foundation models on your prompts, files, or chats. We do not sell your conversations. Optional “palace personalization” in Settings, if you enable it, remembers how you like to work inside Earth Palace. It is not used to train public foundation models. Identity-pack sharing with Snuffy or Hermes is controlled in Settings → Privacy.

You understand and agree that:

• Output can be inaccurate, incomplete, biased, or inappropriate. Review it before you rely on it.
• AI features are not a substitute for professional legal, medical, financial, or other advice.
• You are responsible for how you use output, including compliance with law and third-party rights.
• Similar output may be generated for other users. We do not guarantee uniqueness.
• Project-scoped chats stay in-palace unless you explicitly consent to share private project context with a remote agent.

Connected Earth lets you link third-party accounts, API keys, and endpoints. Credentials are stored encrypted (AES-256-GCM) and used server-side to perform actions you request. Disconnecting a connector deletes stored credentials for that connector when an unlink path exists.

Your use of Google, OpenAI, Anthropic, Gemini, OpenRouter, GitHub, Radio Browser, YouTube, TikTok, Cloudflare, Ollama, a self-hosted Hermes Agent, or any other third party is governed by that party’s terms. We do not control those services. Marking a Hermes channel healthy is not the same as connecting a personal messenger inbox.

Official YouTube and TikTok players in Globe Feed are embeds of those platforms. Other https links may open in an in-app viewer; many sites refuse framing. We do not proxy or rehost third-party video bytes on the federated path. Native hosted video, when enabled, uses a dedicated upload provider under a feature flag.

Jam Surfer radio stations stream from the stations themselves via public radio directories. Earth Palace does not host or rebroadcast those streams. Station metadata is sanitized before we persist it. You are responsible for complying with station and collective-rights rules in your country.

Music files you upload or save are your User Content. Browser-only local files are not uploaded unless you choose a hosted path. Attach Music to Globe Feed or My Feed is limited to radio or hosted uploaded songs — not unsynced local files.

Optional song identification may use licensed recognition providers and open databases. Audio you submit for identification is processed for that purpose and is subject to those providers’ terms.

Palace Messages between two Earth Palace accounts use end-to-end encryption on this device (X3DH and Double Ratchet). Firestore stores ciphertext. Encryption keys live in this browser’s storage. We cannot read those messages. If you lose the device or clear site data, you may lose access to message history. This is not the Signal application and is not multi-device backup unless we later ship that feature and update these Terms.

Agent rooms are this-session live chat, not E2EE palace DMs. Connector lenses for Telegram, Discord, Slack, or WhatsApp are overviews or pairing — not a promise that Earth Palace is your personal inbox for those networks.

Earth Palace, Snuffy, Jam Surfer, Pocket Earth, Globe Feed, Open Palace, and related names, logos, and product design are our trademarks or those of our licensors. You may not use them except as needed to use the Services or with our prior written permission. Open-source components are licensed under their own licenses.

Feedback you send us may be used without restriction or compensation. You are not obligated to provide feedback.

If you believe User Content infringes your copyright, send a notice to team@earthpalace.com with the subject line “Copyright notice” including:

• A description of the copyrighted work claimed to be infringed.
• The location of the material on Earth Palace (URL or post identifier) sufficient for us to find it.
• Your name, mailing address, telephone number, and email address.
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
• Your physical or electronic signature.

We will remove or disable access to material we reasonably believe is infringing and may terminate accounts of repeat infringers in appropriate circumstances, consistent with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) where it applies. If your content was removed and you believe that was a mistake, you may send a counter-notice to the same address.

Parts of Earth Palace are experimental. We may add, change, or discontinue features, including Beta surfaces, without liability to you. We do not guarantee uninterrupted, error-free, or perpetual availability. Globe data, radio directories, third-party embeds, and AI providers can fail for reasons outside our control.

Demo Explorer profiles on Earth are disclosed synthetic characters, not real people. Do not treat them as organic users.

The consumer Services are currently offered without a subscription fee. Third-party providers you connect (for example OpenRouter or OpenAI) may charge you under their own terms. If we introduce paid Earth Palace plans, credits, or Promote campaigns, we will disclose prices, renewal, and cancellation before you are charged, and update these Terms.

Our Privacy Policy explains how we collect, use, and share personal data. It is an important document. It does not reduce rights you have under mandatory data-protection law.

You may stop using the Services at any time. Signed-in users can delete the account from the Hampro menu or Settings → Privacy (you will be asked to confirm and re-authenticate). You may also email team@earthpalace.com from the address on the account. We process deletion as described in the Privacy Policy.

We may suspend or terminate access, remove content, or delete an account if we reasonably believe you breached these Terms, we must do so to comply with law, or your use creates risk or harm to Earth Palace, other users, or third parties. Where practical and lawful, we will notify you.

Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute terms) survive termination.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARTH PALACE AND ITS OPERATORS, LICENSORS, AND SUPPLIERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE, OR THAT CONTENT WILL NOT BE LOST.

We do not control User Content or third-party services. You use AI output, radio streams, maps, and third-party embeds at your own risk. Some jurisdictions do not allow certain disclaimers; in those places, we disclaim warranties only to the extent permitted.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARTH PALACE AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO EARTH PALACE FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100). IF YOU HAVE PAID US NOTHING, OUR LIABILITY IS CAPPED AT US $100.

These limits do not apply to liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud, where such a limitation is prohibited.

You will defend, indemnify, and hold harmless Earth Palace and its operators from claims, damages, losses, and reasonable expenses (including attorneys’ fees) arising out of your User Content, your use of the Services, your use of third-party services through Earth Palace, or your violation of these Terms or of law, except to the extent caused by our willful misconduct.

If a dispute arises, please contact us first at team@earthpalace.com so we can try to resolve it informally. If we cannot, the following applies.

If you are a consumer, and mandatory law in your country of residence requires it, that country’s laws govern these Terms and you may bring claims in the courts of that country.

Otherwise, these Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, and you and Earth Palace submit to the exclusive jurisdiction of the state or federal courts located in California. Either party may still seek injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information, and you may bring an individual claim in small-claims court if you qualify.

These Terms do not require class-wide arbitration. Nothing here limits non-waivable consumer protections.

We may update these Terms as the product, law, or our operations change. We will post the updated Terms on this page with a new effective date. For material changes, we will provide additional notice (for example in the app or by email) at least 30 days before they take effect where required and practical, unless a shorter period is required by law or needed for security.

If you do not agree to the updated Terms, you must stop using the Services and may request account deletion. Continued use after the effective date constitutes acceptance.

These Terms, together with the Privacy Policy and any supplemental terms we present for a specific feature, are the entire agreement between you and us regarding the Services. They supersede prior agreements on the same subject. If a provision is unenforceable, it will be modified to the minimum extent necessary, and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. There are no third-party beneficiaries. Headings are for convenience only.

Open-source software included in the Services is licensed under its own terms. Cesium and other mapping or globe components may require attribution, which we display in the product where applicable.
